Scope of application
These General Terms and Conditions of Business and Donations apply to all contracts concluded via the website of Dr Şahin help gGmbH, in particular for
Monetary donations
Project-related support
the purchase of goods if offered
towards consumers.
Consumers are natural persons who enter into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.
Donations and conclusion of contracts
The donation options presented on the website do not constitute an offer in the legal sense, but a non-binding invitation to make a donation.
By completing the donation process, the donor makes a binding offer of voluntary financial support for the statutory purposes of Dr Şahin help gGmbH.
Acceptance takes place via an automatic donation confirmation by e-mail.
There is no entitlement to the realisation of a specific project at a specific time unless this has been expressly promised.
Use of donations
Dr Şahin help gGmbH uses donations exclusively for its statutory charitable purposes.
A flat-rate share of the donations is retained to cover the necessary organisational, administrative and project costs. The amount of this share is communicated transparently.
If a project is fully funded or cannot be implemented for organisational reasons, Dr. Şahin help gGmbH reserves the right to use the donation for a comparable project.

Specification of billing name and billing address
The donor is obliged to provide the full billing name and the correct billing address as part of the donation process.
These details must match the details of the person from whose account, credit card, PayPal or other means of payment the donation is actually collected or debited.
Dr Şahin help gGmbH reserves the right not to accept, refund or suspend donations for further examination in the event of incomplete, incorrect or obviously deviating information.
This serves in particular to ensure proper accounting, the issue of donation receipts, transparency of the origin of funds and compliance with legal and tax obligations.
Right of cancellation for donations
Donations are voluntary contributions. There is no right of cancellation if the donation has already been used to fulfil the purpose.
The statutory right of cancellation for purchases of goods remains unaffected.
Use of donor names for transparency and accountability
Dr Şahin help gGmbH processes the name provided by the donor for the transparent presentation of the use of donations in accordance with the statutes and for public accountability.
In particular, the donor name can be
in image and video recordings as part of the project documentation
in the presentation of project realisation to the public
in reports, articles and similar publications
are named or displayed.
Processing is carried out on the basis of the legitimate interest in transparency and traceability of the use of funds pursuant to Art. 6 para. 1 lit. f GDPR.
No donation amounts, contact details or other personal data will be published.
Public supporters Leaderboard ranking
In addition, the specified donor name can be displayed in a public list of supporters, known as a leaderboard, on the Dr Şahin help gGmbH website.
During the donation process, donors have the option of selecting the
„I would like to donate anonymously“
to object to the display of their nameonly in the public supporter ranking..
The selection of this option has no influence on
the use of the name in image or video documentation
the presentation in the context of project reports or transparency certificates
Right of objection
Irrespective of the selection made during the donation process, donors have the right to object to the use of their name for the above-mentioned purposes at any time.

Content that has already been published cannot always be completely removed for technical or organisational reasons. However, Dr Şahin help gGmbH will ensure that the donor's name does not appear in future publications.
Sale of goods Delivery and warranty
If goods are offered via the website, the statutory provisions on the purchase contract shall apply in addition.
Delivery shall be made to the delivery address specified by the customer.
The statutory warranty rights apply.
Liability
Dr Şahin help gGmbH shall be liable without limitation in cases of intent and gross negligence as well as in cases of injury to life, limb or health.
In the event of slight negligence, it shall only be liable for breach of material contractual obligations and limited to the foreseeable damage.
Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is Cologne if legally permissible.
Dispute resolution
The European Commission provides a platform for online dispute resolution.
Dr Şahin help gGmbH is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
Final provisions
Should individual provisions be invalid, this shall not affect the validity of the remaining provisions.
